Zenoni & Colombi is the owner of the site www.zenoniecolombi.com. In this document, Zenoni & Colombi will be referred to as "MC DONALD S.R.L.", the company name under which it conducts online sales activities on the site www.zenoniecolombi.com. The general terms and conditions of sale, hereinafter referred to as "GTC", will also apply to new types of services that will be provided in the future by MC DONALD S.R.L., unless otherwise provided at the time of registration or the first provision of the new service.

Acceptance of the GTC and account creation on Zenoni & Colombi

The creation of an account on www.zenoniecolombi.com It is free and optional. The access credentials (email address and password) must be used exclusively by the Customer and cannot be transferred to third parties. The Customer undertakes to keep them secret and to ensure that no third party has access to them and to immediately inform MC DONALD S.R.L. in case they suspect or become aware of any misuse or unauthorized disclosure of the same. Each Customer is allowed to create only one account on www.zenoniecolombi.comIt is therefore expressly forbidden for the same Customer to make multiple registrations. If MC DONALD S.R.L. detects that a Customer has made multiple registrations on the site, it reserves the right to proceed immediately and without prior notice to delete the related secondary accounts on Zenoni & Colombi.

The Customer guarantees that the personal information provided during the account creation procedure on Zenoni & Colombi is complete and truthful. The use of false, and/or invented and/or fictitious names is expressly prohibited, and the Customer undertakes to hold Zenoni & Colombi harmless and indemnified from any damage, compensation obligation and/or sanction arising from and/or in any way connected to the user's violation of the site registration rules or the safekeeping of registration credentials.

The contract concluded between MC DONALD S.R.L. and the Customer is considered concluded with the acceptance, even partial, of the order by Zenoni & Colombi. Such acceptance is deemed tacit, unless otherwise communicated to the Customer by any means. By placing an order in the various provided ways, the Customer declares to have read all the information provided during the purchase procedure and to fully accept these GTC.

If the Customer is a consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity), once the online purchase procedure is completed, they will print or save an electronic copy and in any case keep these GTC, in compliance with the provisions of articles 50 and following of Legislative Decree 206/05.

Any right of the Customer to compensation or indemnity is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or property caused by the non-acceptance, even partial, of an order.

Orders

The Customer can only purchase products listed in the site's electronic catalog. www.zenoniecolombi.com at the time of order submission, as described in the related information sheets.

Minimum order

Customers are not required to meet any minimum spending amount to process an order.

Finalization and conclusion of the contract

Once payment is confirmed, the customer will receive an order confirmation email. It is therefore necessary to have provided a valid address.

Abnormal orders

In the case of orders that appear abnormal in relation to the quantity of products purchased or the frequency of purchases made, MC DONALD S.R.L. reserves the right to take all necessary actions to stop the irregularities. These actions may include:

• The non-acceptance or cancellation of irregular orders;
• The suspension of access to the site;
• The deletion (including permanent) of the Customer account.

False orders

MC DONALD S.R.L. reserves the right to refuse and cancel orders coming from a Customer:

• who has provided false, incomplete or otherwise inaccurate identification data;
• with whom MC DONALD S.R.L. has an ongoing legal dispute;
• who has previously violated these MC DONALD S.R.L. GTC.

In addition to refusing and canceling the order in question, the action may include suspension of access to the site and/or deletion (even permanent) of the Customer account.

Invoicing and tax aspects

The invoice must be requested at the time of order during the cart phase. The necessary data for invoicing are: company name, VAT number, tax code, pec/sdi.

Without the invoice request, the transaction will be entered in the daily cash register record, without issuing a receipt, as per Article 22 of Dpr no. 633/1972 regarding mail order sales, which include online sales.

Once the sale has been entered in the cash register record, it will no longer be possible to issue an invoice. 

Prices

MC DONALD S.R.L. reserves the right to change the prices published on this site at any time. The prices of the products published from time to time cancel and replace the previous ones.

Ownership rights

Ownership of the Products passes to the Customer after full payment of the products or their delivery, if this occurs last.

Product warranty

All sellers are required to apply the new legislative provisions regarding the warranty of consumer goods (Legislative Decree 24/2002). MC DONALD S.R.L. complies with all the requirements of the new legislation concerning the legal warranty, but it will be up to the individual manufacturer to decide the duration and content of the conventional or commercial warranty or good functioning warranty, referring to defects due to prolonged use over time. The latter means the warranty voluntarily provided by the individual manufacturer. MC DONALD S.R.L. will guarantee, according to the manufacturers' indications, 12 or 24 months from delivery if the defect claimed by the consumer constitutes a conformity defect as indicated by Legislative Decree 24/2002.

Returns and refunds

Pursuant to articles 64 and following of Legislative Decree 206/05, the Customer has the right to return within 14 days. It is not possible to return used or washed goods. For personalized items, if conforming to the order, returns are not allowed.

Cases of force majeure

In case of force majeure or unforeseen circumstances, MC DONALD S.R.L. shall not be held responsible for delay or failure to deliver and shall have the right to fully or partially terminate the contract, suspend or postpone its execution.

Changes to the terms of sale

MC DONALD S.R.L. reserves the right to modify the website, sales policies, and these GTC at any time both to adapt to the sale of new products and to comply with new legal provisions. With the warning that the Customer will be subject to the GTC in force at the time they purchase goods from www.zenoniecolombi.com.

Applicable law

These GTC are governed by and must be interpreted in accordance with Italian law.

Competent court

For civil disputes concerning the application of Sections I to IV of Chapter I of Title III of Part III of Legislative Decree no. 206 of September 6, 2005, containing the Consumer Code, the mandatory jurisdiction is that of the judge of the place of residence or domicile of the consumer, if located within the territory of the State; for all others, the Court of Bergamo has jurisdiction.
